POSITION OVERVIEW

The position of Legal Manager will provide support to KTM NA as well as KTM AG legal headquarters in Austria.  This position will also provide general counsel by applying knowledge of North American laws and legal concepts/procedures in a wide variety of legal areas, including but not limited to, product liability, employment and HR law, risk management, Visa administration and contractual obligations – both domestic and international when needed.

ESSENTIAL DUTIES AND RESPONSIBILITIES

·         Assist and act as liaison to legal headquarters in Austria and other departments in NA on all aspects of legal reviews and assessments

·         Support the North America locations in all aspects of legal for corporate and product liability as well as other legal matters

·         Research and compile data to present to President and legal headquarters as needed as well as provide legal memoranda’s and guidance regarding legal matters as requested

·         Draft and maintain legal documents, including but not limited to, leases, operating agreements, financial documents, insurance and racing agreements, amongst others

·         Prepare and maintain records for various entities, assembling documentation for board and committee meetings and other corporate governance functions regarding outstanding legal matters or updates.

·         Administer compliance guidelines for the company and its subsidiaries

·         Manage the NA legal department

·         Oversee insurance policies and coverage

·         Manage and direct product liability cases and the process surrounding each case

o    Notice of claims

o    Attend inspections, depositions, respond to discovery requests, and attend mediation and trial as needed

o    Select, hire and communicate with outside counsel and insurance brokers as needed.

·         Manage green card and visa processing for employees, athletes and interns.

·         Manage all recalls with NHTSA, CPSC, TC; insurance; lemon law claims’ contracts; disclaimers and research.

·         Human Resources support regarding employment law guidance and direction.

·         General legal consultation.

·         Responsible for supervisory duties including scheduling, timecard approvals, performance evaluations, coaching, training, disciplinary actions, task assignment, goal setting and team meetings/communications with support from Human Resources. Provides guidance and develops and empowers direct reports. Ensures work flow and processes are to maximum efficiencies for business necessities.

·         Performs other duties as assigned.

EXPERIENCE REQUIREMENTS: Generally requires a minimum of three (3) to five (5) years of progressively responsible experience in legal matters pertaining to product liability, contracts, risk management and corporate filings. Proficiency in Microsoft Office Suite is a requirement.

EDUCATION REQUIREMENTS:  Juris Doctor Degree from an accredited law school, as well as a member of the State Bar of California.
